Does the Concept of State of Nature Exist in Francisco de Vitoria?
Main Article Content
Abstract
Quentin Skinner made famous the thesis that the Spanish Scholastics, who were forerunners of modern constitutionalist thought, deployed the concept of "state of nature". However, more recently, some scholars have called into question this thesis, calling it "anachronistic". In the present paper, Skinner's original thesis is defended on the basis of the distinction between concept and conception, and it is also concluded that, however, in Vitoria there is no notion of social contract, which is usually associated with that of state of nature.
